Terms of Service

1. Acceptance of Terms

These Terms are an agreement between you and Benanas LLC, the New Jersey company that owns and operates PredictionMarketsPicks, The 7 Oracles app, our MCP servers and our widgets (together, the "Service"; "we," "us"). By accessing or using the Service, you agree to be bound by these Terms of Service. If you do not agree, do not use the Service. These terms apply to all visitors, subscribers, and users of the Service and its tools.

2. Not Financial or Legal Advice

All content on PredictionMarketsPicks — including market data, analysis, articles, tools, newsletters, and any other materials — is provided for informational and educational purposes only. Nothing on the Service constitutes financial advice, investment advice, trading advice, or any other form of professional advice.

This applies equally to our edge alerts, the Edge Alerts API, our MCP tools, and any signals we publish to Discord. All such signals are impersonal market analysis, published simultaneously and identically to every subscriber. They are informational only; they create no advisory or fiduciary relationship, and they are not trade recommendations tailored to any individual.

Prediction markets involve real money and real risk. Past performance of any market or strategy discussed on the Service does not guarantee future results. You are solely responsible for your own trading decisions. Always do your own research and consult a licensed financial advisor before making financial decisions.

3. Eligibility

You must be at least 18 years old to use the Service. By using it, you represent that you are 18 or older and able to enter into these Terms.

Each prediction market decides who may open an account, and its rules can be stricter than ours. Polymarket US, for example, requires that you be at least 18 and the age of majority where you live (19 in Alabama and Nebraska, 21 in Mississippi). Platforms such as Kalshi, Polymarket US, DraftKings Predictions and FanDuel Predicts may be unavailable, or may limit some contracts, where you are, and Polymarket.com, the international book, is view-only for US users. It is your responsibility to confirm that a platform is legal and available where you are before you use it.

4. Intellectual Property

All content on the Service — including articles, analysis, tools, graphics, and branding — is owned by or licensed to Benanas LLC, which operates PredictionMarketsPicks. You may not reproduce, distribute, modify, or create derivative works without express written permission, except for sharing our charts and graphics as described in “Using our graphics” below.

Market data displayed on the Service is sourced from third-party platforms (Kalshi, Polymarket, etc.) and is subject to their respective terms and licenses.

5. Third-Party Links & Affiliate Relationships

The Service links to third-party platforms, including Kalshi, Polymarket US, Polymarket.com, DraftKings, FanDuel, Novig, Robinhood and Fanatics. Some links and codes are affiliate or referral links or codes: if you open an account, deposit or trade after using one, we may be paid. PredictionMarketsPicks is a paid partner of Polymarket US, and any page that shows a Polymarket US price or offer says so next to it.

Offers such as sign-up bonuses or trading credits are made and administered by the platform under its own terms. We don't decide who qualifies, we don't pay or hold bonuses, and we never hold your money, take your orders or trade for you. Partnerships never change our prices, rankings, edges or model outputs. Our Affiliate Disclosure lists every relationship.

We are not responsible for the content, privacy practices, or terms of any third-party site. Use them at your own discretion.

6. Prohibited Conduct

You agree not to:

• Use the Service for any unlawful purpose
• Scrape, crawl, or systematically download content from the Service without permission, or in excess of the published API rate limits
• Redistribute, resell, rebroadcast, or publicly re-post the alerts, the Edge Alerts API feed, or any derivative real-time feed
• Share, transfer, or resell an API key, or circumvent rate limits or the delayed-feed window
• Use several MCP endpoints, sessions or accounts to get around a usage limit or Pro access rule
• Attempt to gain unauthorized access to any part of the Service
• Use the Service to transmit spam or unsolicited communications
• Impersonate PredictionMarketsPicks, Benanas LLC or anyone on our team
• Use a VPN, proxy, false location or false information to see or use an offer, or to reach a platform, that isn't available where you are
• Use our referral links or codes in bulk, with automated tools, on someone else's behalf, or in any other way meant to inflate referrals
• Remove, hide or change any disclosure, attribution or disclaimer in our pages, widgets, alerts or tool results when you share or embed them

7. Disclaimer of Warranties

The Service and all content are provided "as is" without warranty of any kind, express or implied. We make no representations regarding the accuracy, completeness, or timeliness of market data or analysis. Market data may be delayed or contain errors. Use it accordingly.

8. Limitation of Liability

To the maximum extent permitted by law, Benanas LLC, PredictionMarketsPicks, their members, contributors and partners shall not be liable for any direct, indirect, incidental, special, or consequential damages arising from your use of the Service or any prediction market platform referenced herein, including trading losses.

9. Subscriptions & Billing

PredictionMarketsPicks offers a Pro subscription available on a monthly or annual basis.

Auto-renewal: By subscribing, you authorize us to charge your payment method automatically at the start of each billing period (monthly or annual, per the plan you chose) on a recurring basis, and your subscription renews automatically each period until you cancel.

Cancellation policy: You may cancel your subscription at any time through the billing portal accessible from your Account page. Cancellation takes effect at the end of your current paid period — you retain full Pro access through that date and will not be charged again. We do not issue prorated refunds for unused time within a billing period already paid for; access simply continues through the end of the period you paid for.

These billing, auto-renewal, and cancellation terms are also presented to you at checkout before you subscribe.

Promotional prices: A promotional price applies only to the period stated at checkout (for example, the first year of an annual plan). After that the plan renews at the regular price then in effect.

Pro is purchased only on our website. If you use the app, your subscription is still billed and managed through your website account.

To cancel, go to Account → Cancel subscription. If you have trouble cancelling, contact us at predictionmarketspicks@gmail.com and we will process it for you.

10. API, Data Feeds & Alert License

If you subscribe to a plan that includes API access or edge alerts, we grant you a limited, personal or single-organization license to access the Edge Alerts API and the alerts we publish, for your own use only.

You may not redistribute, resell, rebroadcast, publicly re-post, or create any derivative real-time feed from the alerts or the API. API keys are personal and non-transferable and may not be shared. Rate limits apply, and we may throttle, rotate, or revoke keys at any time for a violation of these Terms. The feed is provided without any uptime warranty, and its content, coverage, timing, and delay windows may be modified or discontinued at any time.

12. Open-Source Software

Any software we publish — including the open-source, non-custodial executor for the Edge Alerts API — is licensed separately under its own license (the MIT License) and is provided "AS IS," without warranty of any kind.

Such software runs entirely on your own systems, under your own configuration. PredictionMarketsPicks never receives, stores, or has access to your exchange credentials or your funds. You bear sole responsibility for every order placed, for all configuration of the software, and for your compliance with the terms of any exchange you connect it to. Publishing this software is not a recommendation to trade.

13. The 7 Oracles App

The 7 Oracles app is provided by Benanas LLC, not by Apple or Google, and these Terms are between you and Benanas LLC only. We grant you a limited, non-transferable license to use the app on devices you own or control, as the App Store and Google Play usage rules allow. We alone are responsible for the app, its content, maintenance and support; Apple and Google have no obligation to support it. If the app fails to meet any warranty that applies, you may notify Apple, and Apple will refund the purchase price, if any; Apple has no other warranty obligation for the app. We, not Apple, are responsible for any claim relating to the app, including product liability, legal or regulatory compliance, consumer protection and intellectual property claims. You represent that you are not located in a country subject to a US Government embargo or designated by the US Government as a "terrorist supporting" country, and that you are not on any US Government list of prohibited or restricted parties. You must also follow any third-party terms, such as your wireless carrier's, when you use the app. Apple and its subsidiaries are third-party beneficiaries of these Terms with the right to enforce them against you.

The app takes no orders, holds no funds and sells no contracts; buttons that open an exchange take you to that exchange's own site under its own terms. Partner offers in the app follow the same location rules as the website. Push notifications can arrive late or not at all — don't rely on them for time-sensitive trading decisions.

14. AI Assistants and MCP

Our MCP servers let AI assistants read our tools. Tool results are market information, not recommendations, and can be delayed or wrong, so check numbers against our site and the platform before you act on them. When a result includes a price from a platform we have a paid partnership with, it carries a disclosure line, and we ask assistants to keep it; we never put referral codes or partner sign-up links in tool results. The same usage limits and Pro access rules apply across every MCP endpoint. Using several endpoints, sessions or accounts to get around a limit is prohibited, and so is using our MCP servers to build a competing data product or to resell their output. Free tools and limits may change.

The assistant you use is a third party: we are not responsible for how it restates, summarizes or presents our data.

15. Email Communications & Consent

By providing your email address on the Service — whether through free tool access, account registration, or any other form — you agree to receive transactional emails related to your account (including sign-in links and codes) and, where indicated, our newsletter and market updates. In the app, you also agree to receive the push notifications you turn on; you can turn them off at any time in the app or in your phone's settings.

Our newsletter and marketing emails are delivered via Beehiiv. By submitting your email, you acknowledge that your information will be processed in accordance with Beehiiv's Terms of Use and Privacy Policy. Subscribers added via our platform have affirmatively provided their email address and consented to receive communications from PredictionMarketsPicks.

You may unsubscribe at any time using the unsubscribe link in any email we send, or by emailing predictionmarketspicks@gmail.com.

16. Changes to These Terms

We may update these Terms. When we do, we change the date and version at the top of this page. If a change is material, we'll email Pro subscribers before it applies to them. Continued use of the Service after changes are posted means you accept the updated Terms.

17. Governing Law

These Terms are governed by the laws of the State of New Jersey, without regard to its conflict-of-law rules. Any dispute will be brought in the state or federal courts located in Hudson County, New Jersey, and you consent to their jurisdiction.
